II. General information on data processing

1. Extent of personal data processing

In principle, we collect and use our users’ personal data only insofar as doing so is necessary to providing a functional website and to providing our contents and services or if they were provided voluntarily. Our users’ personal data is collected and used only after the user has given his consent to this effect or where it is based on a legal basis (according to the GDPR).

Insofar as we obtain the data subject’s consent to process their personal data, Art. 6, Para. 1, lit. a of the GDPR shall apply as the legal basis for personal data processing.

In the event of personal data which is necessary to fulfilling a contract, the contracting party for which is the data subject, being processed, Art. 6, Para. 1, lit. b of the GDPR shall apply as the legal basis. This also applies to processing which is required to carry out pre-contractual measures.

If personal data needs to be processed to fulfil a legal obligation to which our company is subject, Art. 6, Para. 1, lit. c of the GDPR shall apply as the legal basis.

In cases where the vital interests of the data subject or another natural person necessitate processing of personal data, Art. 6, Para. 1, lit. d of the GDPR shall apply as the legal basis.

If processing is necessary to protecting a legitimate interest on the part of our company or a third party, and if the data subject’s interests, fundamental rights and fundamental freedoms do not take precedence over the former interest, Art. 6, Para. 1, lit. f of the GDPR shall apply as the legal basis for processing.

2. Rights of the data subject

You have the right to request information about any of your personal data we process. In particular, you have the right to request information about the purposes of the processing, the categories of personal data, the categories of recipients who will have access or were disclosed with your data, the duration periods for saving the personal data, whether there is a right to correct, erase, restrict the processing or object, the source of your data if not collected through us and if we use automatic decision-making technologies including profiling.

Additionally, you have the right to revoke a previously granted consent to use your personal data at any time.

If you believe that the processing of your personal data is inconsistent or contradicts the applicable data protection laws, you have the possibility to lodge a complaint with a supervisory authority.

III. Provision of the website and creation of log files

We analyze the usage of our web presence with the web analytics service Google Analytics (https://www.google.com/policies/privacy/partners/). This is exclusively for the purpose of optimizing the website with regards to usability and the provision of useful information about our services. A merger of data with other personal data sources or disclosure to third parties is precluded. No evaluation of personal data takes place. All analyses are based on anonymous datasets.

The legal basis for the temporary storage of data and the log files is Art. 6, Para. 1, lit. f of the GDPR.

IV. Use of cookies

Our website uses cookies. Cookies are text files which are stored in the user’s Internet browser or on the user’s computer system by the Internet browser. If a user accesses a website, a cookie may be stored on the user’s operating system. This cookie contains a characteristic character string which enables unique identification of the browser the next time the website is called up.

We use cookies to make our website more user-friendly. Some elements of our website require the accessing browser to also be identifiable after a page change. The user data collected by technically necessary cookies is not used to create user profiles.

V. Contact form and email contact

If you fill out a contact form, send us an email or another form of electronic message, your data will only be stocked to process your inquiry and possible further related questions you might have and used uniquely in the context of the inquiry.

The legal basis for data processing, provided that the user has given their consent to this effect, is Art. 6, Para. 1, lit. a of the GDPR.

The legal basis for processing data transferred in the course of sending an email is Art. 6, Para. 1, lit. f of the GDPR. If you have contacted us by email with the aim of concluding a contract, Art. 6, Para. 1, lit. b of the GDPR forms an additional legal basis.

VI. Online store

The data is processed in line with the legal conditions on processing the request. Data is only used to send further information and offers relating to Swisspica products with your consent.

We process personal data from the input screen to set up a customer account and for the purposes of sending and payment of the requested products. If the user has given their express consent to this effect, we also use the data to provide information about Swisspica products. The other personal data processed during the sending process is used to prevent misuse of the contact form and to ensure the security of our IT systems.

The details of the selected payment transaction shall be disclosed to our payment service provider for the purpose of executing the payment.

The legal basis for data processing, provided that the user has given their consent to this effect, is Art. 6, Para. 1, lit. a of the GDPR.

VII. Use of social media components (plug-ins)

All embedded social plug-ins use the two-click process. This means that the recording of your surfing patterns by a plug-in will only start if you activate it. If you are logged in to, for example, a social media account while using our website, this plug-in will register the visit on our website on the first click and can match it to your user account. You will find further information concerning this matter in the private policies of the respective social media companies.

VIII. Data security

During your visit on our website, we use a common encryption technology in connection with the highest encryption level that is supported by your browser. If a page on our website is being transmitted encrypted, it is shown by the closed lock or key symbol in the address bar of your browser.
